As Professor Yunus said, poverty is not created by poor people. Poverty “is created by an economic system in which all the resources tend to keep surging up toward the top, creating an ever-expanding mushroom head of wealth belonging to only one percent of the people” (M. YUNUS, A World of Three Zeroes, London, 2018, p. 48).

The current economic system has shown to be a flawed one. It has failed in spreading a general well-being, while it has exacerbated inequalities. How can we fix it?

Social business can be an appropriate tool to redesign capitalism.

The conference is a "mix" of legal aspects, economy and philosophy. Starting from the features of a social business, we will expand our view to our current economic model in an attempt to "redesign it". Since an economic model is built by men, it has to mirror human nature. Consequently, we will also focus on human nature.

The “Social Enterprise” is a new way of doing enterprise, which, as pointed out by the European Union, can drive a material change in the economic model which shapes the common market. After a first disappointing attempt of 2006, Italian legislature, with Legislative Decree July 3, 2017, no. 112, has adopted a new regulation of the “Social Enterprise” (i.e. “Impresa Sociale” in Italian language). The aim of the new regulation is to overcome the shortcomings of the old one adopted in 2006. More in detail, Legislative Decree July 3, 2017, no. 112 provides for a less strict distribution constraint and certain tax benefits. The Author gives a first overview of the new regulation, also explaining the development of the Social Enterprise in the wider context of the third sector.
